The Breakfast League Constitution
Drafted by Kenneth Pancake
Ratified on the Holiest of Days, DRAFT DAY
August 30th, 2016
Edited January 9th, 2021
Amended Various Times
Replaced January 11, 2025

Article I – General Structure

Clause I:
The Breakfast League has an executive leader & assistant (The Commissioner and Lieutenant Commissioner). The entire league (with the exception of un-ratified substitute members as clarified in A III C V) serves as a legislative branch.

Clause II:
The Breakfast League will hold two events in person every year: the Rules Committee Meeting, and THE DRAFT. THE DRAFT is to be held on The Holiest of Days, DRAFT DAY, which shall be appointed as clarified in A II C II. The Rules Committee Meeting must be held within two weeks of the conclusion of the previous season, on a date determined by the Commissioner.

Clause III:
Dues are $25 for each member. Dues must be paid before the draft for each season. Dues can be paid to the Commissioner or the Lieutenant Commissioner. These dues will be redistributed at the end of the season at a 8/4/2/1 split.

Clause IV:
The Commissioner must randomize and announce the drafting order for the Holiest of Days, DRAFT DAY, with at least one week’s notice before that day arrives.

Clause V:
Any power not mentioned here as a Commissioner responsibility is a Rules Committee responsibility.

Clause VI:
According to a change on January 9th of 2021, the League shall be comprised of 12 members, sorted into three divisions of four owners each, to play 17 games in one season, including six against division opponents and the remainder against out-of-division opponents. The membership of each conference shall be determined at the discretion of the Commissioner.

Clause VII:
No rules, settings or constitution changes may be passed and placed in effect between the first pick of the draft and the conclusion of the season.

Clause VIII:
Per our League’s second amendment, any member legally permitted to carry a weapon is so allowed to carry that weapon at a Breakfast League meeting.

Clause IX
Per an amendment passed in 2020: If for any reason the NFL football season shall be altered; and if that alteration eliminates a week or more of Breakfast League regular season competition, all dues shall be refunded for that season - regardless of playoff completion or lack thereof. However, if that alteration eliminates a week or more of Breakfast League POST-season competition, the regular season's final standings shall be taken as the season's final standings, and dues will be awarded respectively.

Clause X
The Holiest of Days, DRAFT DAY, may never take place on September 7th, per a 2020 amendment.

Clause XI
Every Committee vote must be posted to the Facebook page for 48 hours prior to the vote being finalized.

Article II – Rules Committee

Clause I:
The Rules Committee consists of everybody in the league. This does not include proposed members or substitutes until they're voted in, as mentioned in A III C V.

Clause II:
At the Rules Committee Meeting, the Breakfast League should do the following in no specific order: elect a commissioner as outlined in C III of this Article, confirm any new member by majority vote, pass any constitutional amendments by majority vote, and if necessary, confirm a date for The Holiest of Days, DRAFT DAY, by majority vote. These jobs are detailed in the rest of this Article. The Commissioner is the tiebreaking vote in any tie, with the exception of a Commissioner election.

Clause III:
Any member who has been confirmed by the Rules Committee can run for Commissioner. The seat goes to whoever gets the most votes. The tiebreaker is a little complicated: in the event of a tie between two candidates, the tiebreaker is the vote of the highest-ranked member from the previous year's standings. But, not if that person is one of the tied candidates! Also, naturally, if there are three candidates with two tied for first, the winner can't be the third-place candidate, even if last year's champion voted for him/her.

The Commissioner then picks a Lieutenant Commissioner.

Clause IV:
If there's a vacancy to be filled for the coming season in the league, the Commissioner should suggest a replacement, who must be voted in by majority.

Clause V:
League amendments to the Constitution require a majority vote. The difference between a setting and amendment is that if it's on a topic mentioned in the Constitution, it's an amendment.

Clause VI:
If circumstances shall arise whereas the Commissioner breaks the conditions of the Constitution herein, a 75% vote of the Rules Committee (not including the vote of the Commissioner) shall impeach and remove the Commissioner from power. An emergency election shall be held immediately, and the new Commissioner shall appoint a new Lieutenant Commissioner.

Article III – Commissioner

Clause I:
The Commissioner will have administrative access to the Breakfast League on both the ESPN platform and the Facebook group page, as well as the Breakfast League website.

Clause II:
This position is elected as detailed in A II, C III.

Clause III:
The Commissioner shall:

-Lead all Rules Committee Meetings.

-Promptly update the League Constitution and the League settings as needed.

-Promptly update the League’s all-time records.

-Have the right to change any ESPN league setting not mentioned in the Breakfast League constitution, per the Kaelan Amendment.

The Lieutenant Commissioner may help the Commissioner with these tasks, along with any other task named in the Constitution as a duty of the Commissioner, with the exception of a replacement appointment either mid-season or in season, or initiating a vote to remove a member from the League.

Clause IV:
If an owner leaves during the season, the Commissioner can replace that owner for the time being with someone from outside the league. This will need no confirmation from the Rules Committee.

Clause V:
If Clause IV happens, that new owner is not a member of the Rules Committee until if and when the Rules Committee confirms them as a member for the next season.

Clause VI:
The Commissioner can initiate a vote to remove a League member. This must pass by 75% of the League, not including either the vote of the Commissioner or the subject of the vote.

Clause VII:
While the Commissioner has access to change the League settings at his discretion, the Commissioner must not change the settings in a corrupt way so as to benefit his team.

Article IV – Lieutenant Commissioner

Clause I:
The Lieutenant Commissioner helps at the pleasure of the Commissioner, and is the next-in-line to the seat of Commissioner.

Clause II:
In the event that the Commissioner is briefly incapacitated or unable to lead effectively (by either confession or by majority vote of the rules committee), the Lieutenant Commissioner becomes the Interim Commissioner until such circumstances resolve. In the case of a permanent and sudden absence, the Lieutenant Commissioner shall become the Commissioner until the next election cycle. The new Commissioner shall immediately appoint a Lieutenant Commissioner.

Clause III:
The Lieutenant Commissioner shall have Administration Access to the Breakfast League in both the ESPN website and the Facebook group, along with the League website.

Article V – Hall of Fame

Clause I:
Each year, starting in 2018, the league will vote on one team to add to the Breakfast League Hall of Fame. These teams must be specific to a year, for example, Kaelan Carlson's 2014 team, or Eli Thompson's 2017 team.

Clause II:
The Commissioner will select 3 teams to choose from for this vote every year.

Clause III:
There will also be a Hall of Shame. The process for selection is the same as Clause I and II.
